This website is operated by Atelier Fabien. Ensomono is a registered trademark of Atelier Fabien. By accessing https://ensomono.com or purchasing from us, you agree to be bound by these Terms & Conditions (“Terms”), together with any policies referenced here (including our Privacy Policy and Shipping & Returns information).

1. Eligibility

You must be at least 18 years old and purchasing as a consumer (not for resale). If you are under the age of majority, you may only use the site with the consent of a parent or legal guardian.

2. Products & availability

  • Ensomono products are made in limited quantities. Small variations in colour, grain, or finish may occur due to the nature of leather and hand-finishing.
  • We strive for accuracy in product descriptions and images but cannot guarantee exact colour representation across devices.
  • We may limit quantities, discontinue products, or restrict sales to certain regions.

3. Prices, taxes & currency

  • Prices are shown in EUR and include Belgian VAT unless stated otherwise.
  • Shipping costs are calculated at checkout based on destination and service level.
  • For orders outside the EU, import duties, taxes and fees may apply and are payable by you to the carrier or customs authority.

4. Orders & contract formation

  • Your order is an offer to purchase.
  • We confirm receipt by email; the contract is formed when we dispatch your order and send a shipping confirmation.
  • We may refuse or cancel orders (e.g., due to stock limits, payment issues, or suspected fraud).

5. Payment

  • Payments are processed securely by third‑party payment providers.
  • We do not store your complete payment details.
  • You authorise us to charge the total order amount at checkout.

6. Shipping & delivery

  • Orders ship from Belgium with reputable carriers.
  • Any delivery dates provided are estimates; delays may occur.
  • Risk in the goods passes on delivery; title passes once payment is received in full.

7. Right of withdrawal (EU/EEA/UK/CH consumers)

  • You have a legal 14‑day cooling‑off period starting the day after you (or a person you designate) receive the goods.
  • To exercise this right, email info@ensomono.com within the 14‑day period and return goods promptly in original condition and packaging.
  • We will refund the product price and the standard outbound shipping cost. Return shipping is at your expense unless the goods are faulty.
  • We may deduct any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the goods.
  • This right does not apply to personalised or custom‑made items.

8. Returns & exchanges (goodwill)

Outside the legal withdrawal period, we may offer returns or exchanges at our discretion, subject to the goods being unused and in original condition. Please contact us within 14 days of delivery to request an exchange.

9. Faulty goods & legal guarantee

Your purchase benefits from the two‑year legal guarantee of conformity under Belgian and EU law. If goods are faulty or not as described, contact us promptly so we can arrange repair, replacement, or refund.

10. Prohibited uses

You may not use our site or products for unlawful purposes or in violation of applicable laws, including (without limitation): infringing intellectual property rights, transmitting malware or spam, or engaging in fraudulent, abusive, or misleading conduct. We may suspend or terminate access for violations.

11. Intellectual property

All site content (including product designs, text, images, and trademarks) is owned by or licensed to Ensomono. No licence is granted except as necessary to browse and purchase from the site. Reproduction or distribution is prohibited without prior written consent.

12. Liability

  • We are not liable for indirect, incidental, or consequential damages.
  • Our aggregate liability for any claim related to a purchase is limited to the amount you paid for that purchase.
  • Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

13. Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (including but not limited to natural events, strikes, transport disruptions, or government actions).

14. Privacy & cookies

Your personal data is handled according to our Privacy Policy, which includes our Cookie Policy.

15. Governing law & disputes

  • These Terms are governed by Belgian law.
  • Disputes may be submitted to the courts of Limburg (Hasselt), without prejudice to mandatory consumer forum protections.
  • Belgian consumers may contact the Consumer Mediation Service for out‑of‑court resolution: www.mediationconsommateur.be.

16. Changes to these Terms

We may update these Terms from time to time. The version published on our website at the time of your order applies to that order.
